Frequently Asked Questions
What should I do if I’m being investigated for a sex crime in Dallas?
Do not give a statement to police or CPS without a lawyer, even if you are innocent and want to explain. Save your texts, photos, and call logs, and avoid contact with the accuser. Then call a defense attorney before you are charged; early action can shape whether and how a case is filed.
What is the penalty for sexual assault in Texas?
Sexual assault under Penal Code §22.011 is usually a second-degree felony, punishable by 2 to 20 years in prison and up to a $10,000 fine. Some circumstances raise it to a first-degree felony (5 to 99 years or life), and aggravated sexual assault carries higher minimums. A conviction also requires sex offender registration. Your defense starts with whether the State can prove every element, including lack of consent.
What is the difference between indecency with a child by contact and by exposure?
Under Penal Code §21.11, contact (sexual touching of a child under 17, including through clothing) is a second-degree felony, 2 to 20 years. Exposure is a third-degree felony, 2 to 10 years. Both can require sex offender registration, including after deferred adjudication. Negotiating to a non-registerable offense or challenging the outcry statement can change the outcome.
What happens if I’m charged with continuous sexual abuse of a child?
Penal Code §21.02 requires the State to prove two or more acts of sexual abuse over a period of 30 or more days against a child under 14. It is a first-degree felony with a minimum of 25 years and a maximum of 99 years or life. These cases often rest on testimony alone, so independent investigation and a careful review of forensic interviews matter.
How long do I have to save my license after a Dallas DWI arrest?
15 days. Texas DPS gives you 15 days from the date you are served with a notice of suspension to request an ALR hearing (20 days from the mailing date if you gave a blood specimen). Miss it and the suspension takes effect automatically. Calling a lawyer right after your arrest protects that window.
What are the penalties for a first DWI in Texas?
A first DWI is a Class B misdemeanor: 72 hours to 180 days in jail and a fine up to $2,000, plus a possible license suspension. A BAC of 0.15 or higher makes it a Class A misdemeanor (up to 1 year and $4,000). A child passenger under 15 makes it a state jail felony. Breath tests, blood tests, and the traffic stop itself can all be challenged.
